Virginia requires uninsured and underinsured motorist coverage on auto policies for a reason: too many drivers carry no insurance or far too little. When that driver hurts you, the protection you paid for is supposed to step in. The problem is, now your own insurer is the one trying to pay less.

When the At-Fault Driver Cannot Pay, You Still Can Recover.

You did everything right. You carried insurance. Then someone with no coverage, or a bare-minimum policy, caused a serious crash and left you with bills far beyond what they can pay.

This is exactly what uninsured and underinsured motorist coverage is for. Virginia law requires it, and it lets you turn to your own policy to cover the gap. But filing a UM or UIM claim means negotiating against your own insurer, which suddenly behaves like any other company trying to limit a payout.

We handle the claim against your insurer the same way we handle any other, with evidence, a documented demand, and a refusal to accept less than the coverage you paid for.

Attorney Insight

“People are often shocked to learn that their biggest fight after a crash is with their own insurance company. When the at-fault driver has no coverage, your uninsured motorist policy is supposed to fill the gap, but the moment you file, your insurer starts acting like the opposing party. I treat a UM claim exactly like any other injury case: build the evidence, document the full loss, and refuse the lowball. You paid premiums for this protection. My job is to make the company actually deliver it.”

Common Questions

Answers Before You Call

What is the difference between uninsured and underinsured coverage?
Uninsured motorist coverage applies when the at-fault driver had no insurance. Underinsured coverage applies when they had some, but not enough to cover your losses. Both let you turn to your own policy.
Does Virginia require this coverage?
Yes. Virginia requires uninsured and underinsured motorist coverage on auto policies, so you likely have it even if you did not realize it. We review your policy to confirm the limits.
Will filing a UM claim feel adversarial?
Filing a valid claim for coverage you paid for is your right. While your insurer may negotiate hard, we handle that fight so you are not facing your own company alone.
What if the driver fled the scene?
A hit-and-run can often be treated as an uninsured motorist claim, letting you recover under your own policy even when the other driver is never found.
How long do I have to act?
Generally two years in Virginia for the underlying injury, and UM claims carry their own notice requirements, so contact us early to protect the claim.
What does it cost?
The consultation is free and these claims are handled on contingency, so there is no fee unless we recover for you.

Make Your Policy Pay What You Are Owed

You paid for uninsured motorist protection. When you need it, we make your insurer honor it. Serving injured drivers across Northern Virginia.
