The driver says I stepped into traffic. Can I still recover?
Possibly, but you must be careful. Virginia’s contributory negligence rule can bar recovery for any fault, so we investigate the signals, the crosswalk, and the driver’s conduct before you concede anything.
Do pedestrians always have the right of way?
Not always, and the rules depend on the location and signals. We analyze exactly where and how the crash happened to establish the driver’s duty and breach.
I was biking without all the recommended gear. Does that matter?
The central question is whether the driver was negligent. Gear can be raised, but it does not excuse a driver who failed to yield or pay attention.
